M&S gift card with funeral plan purchase - offer Terms & Conditions

  1. “We” or “Us” means Distinct Cremations. Distinct Cremations is a trading style of Distinct Funeral Plans Limited, which is authorised and regulated by the Financial Conduct Authority. Financial Services Register No. 965289. Registered in England No. 13366327. Registered office: Head Office Westerleigh Crematorium, Westerleigh Road, Westerleigh, Bristol, BS37 8QP. Part of the Westerleigh Group (“the Promotor”).
  2. ‘Purchaser’ means the person applying for and paying for the plan.
  3. “Application” means the electronic, paper or telephone voice-recorded request by you to take out a funeral plan.
  4. “Funeral Plan Agreement” means the written agreement between us once we have received your application.
  5. ‘Promotion’ means the offer by us, described in these Terms & Conditions.

The promotion

  1. A Purchaser has to be aged 18 or over to purchase a funeral plan with us.
  2. For any funeral plan Application received by us before the Promotion end date of 30th June 2025, where the Purchaser is paying the full advertised price, the Purchaser will receive a gift card from us, whether they are a new Purchaser or have enquired previously about our funeral plans.
    7.1. A Purchaser who takes out a Direct Cremation Plan for £1,899 will receive a £100 M&S gift card.
    7.2. A Purchaser who takes out a Funeral Service Plan from £2,399 will receive a £200 M&S gift card.
  3. The Promotion only applies to plans paid in either a single payment or up to 12 monthly instalments. Plans paid for over 5 or 10 years are not eligible for the gift card mentioned in point 7.
  4. The Promotion is not valid in conjunction with any other offer.
  5. The gift cards will be sent by post 60 days after a plan is activated by us following receipt of the Application.
  6. When purchasing a plan, if the Purchaser intends for that plan to cover the funeral of someone else, the Purchaser will be entitled to the gift card and not the person whose funeral is covered.
  7. Only one plan can be taken out to cover the Purchaser’s funeral. However, where the Purchaser takes out more than one plan to also cover someone else’s funeral, all plans in the Purchaser’s name will be eligible for the gift card.
  8. No gift card will be sent if the Funeral Plan Agreement is cancelled within 60 days of activation by us.
  9. This Promotion can be withdrawn by us at any time.
  10. The gift card has no cash value, and we cannot take £100 or £200 off the price of a plan as an alternative.

  12. We may cancel the gift card offer should we discover, or have a reasonable suspicion to believe, that the terms of the Promotion are being abused.
  13. In the unlikely event that we are unable to fulfil your gift card offer, we will contact the Purchaser to let them know and discuss alternatives of equal value.
  14. The gift card offer is not open to employees or contractors of Distinct Cremations or any of its subsidiary companies.
  15. The Promotion ends 30th June 2025.
  16. These terms and conditions are governed by the law of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.
